Terms & Conditions

These Terms & Conditions (“Terms”) govern all services provided by KONST (“we”, “our”, “us”) to our clients (“you”, “your”). By engaging our services, you agree to the following:

1. Payment Terms

  • All invoices are considered fully due and payable once issued.

  • Payment is due within 14 calendar days of the invoice date, unless otherwise agreed in writing.

  • Late payments incur a 5% weekly late fee applied to the outstanding balance.

2. Deposits & Prepaid Amounts

  • Any deposit or partial payment made to secure a service (such as a photoshoot, content creation, or strategy session) is non-refundable.

  • At our discretion, prepaid amounts may be held as credit toward future services, but cannot be applied toward existing or outstanding invoices unless explicitly stated in writing.

3. Rescheduling & Cancellations

  • For any service involving reserved time (e.g., content shoots, strategy calls), at least 5 business days’ notice is required to reschedule without penalty.

  • Cancellations made with fewer than 5 business days’ notice will result in the forfeiture of any deposit or prepaid amount.

  • If a project is cancelled after work has begun, KONST reserves the right to charge for 50% of the total project fee or the time invested to date (whichever is greater).

4. Scope of Services

  • All services delivered are based on the agreed scope (via email, proposal, or signed contract).

  • Any requests outside the original scope will be quoted and billed separately.

5. Deliverables & Timelines

  • We will deliver all agreed services and assets within confirmed timelines.

  • Delays caused by client unresponsiveness, missing materials, or delayed approvals are not the responsibility of KONST and may affect delivery without penalty.

6. Ownership, Copyright & Intellectual Property

  • All final deliverables (photos, videos, strategy documents) become the client’s property only once the invoice is paid in full.

  • KONST retains ownership of all raw files, drafts, proprietary methods, strategy frameworks, templates, and moodboards unless otherwise licensed in writing.

  • Clients may use final deliverables for marketing and internal purposes only. Resale, redistribution, or replication of KONST’s processes, templates, or intellectual property without written consent is strictly prohibited.

  • KONST reserves the right to use non-confidential final work for its own marketing and portfolio purposes unless otherwise agreed in writing.

7. Liability Limitations

  • KONST’s total liability for any claim shall not exceed the total amount paid by the client for the specific service in question.

  • KONST is not responsible for indirect or consequential damages, including but not limited to loss of revenue, sales, or opportunities.

8. Force Majeure

KONST shall not be held liable for delays or non-performance caused by circumstances beyond our reasonable control, including but not limited to illness, accidents, equipment failure, natural disasters, or government restrictions.

9. Refunds

  • Due to the customised nature of our services, all fees are non-refundable once work has commenced, even if the client is unsatisfied with results.

  • Outcomes depend on multiple factors outside KONST’s control.

  • KONST will make reasonable efforts to address concerns but cannot guarantee specific outcomes.

10. GDPR & Data Protection

  • KONST complies with all GDPR regulations.

  • Client information, account access, analytics data, and personal data will only be used for the purposes of delivering agreed services.

  • Data will not be shared with third parties except as required by law.

11. Governing Law & Jurisdiction

These Terms and all services provided by KONST are governed by Belgian law.
Any disputes shall be resolved exclusively in the courts of Brussels, Belgium.

12. Dispute Resolution

  • Any disputes regarding invoices, deliverables, or services must be raised in writing within 5 calendar days of receiving the invoice or final deliverable.

  • Both parties agree to work in good faith to resolve disputes before pursuing legal action.
